Man Disabled in Road Accident Gets Over ₹58 Lakh Compensation
A Delhi Motor Accident Claims Tribunal has awarded over ₹58 lakh as compensation to a 34-year-old man who suffered permanent disability after a road accident.
The tribunal held that the accident was caused due to rash and negligent driving of a car.
Accident Near IGI Airport in 2020
The case relates to an accident that occurred on February 27, 2020, near the Indira Gandhi International Airport in Delhi.
The victim, Pradeep Mehra, was riding his motorcycle when a car hit him from behind.
He sustained serious injuries and was left with permanent physical disability.
Mehra later filed a compensation claim before the Motor Accident Claims Tribunal.
Tribunal Finds Driver Negligent
The tribunal, presided over by Rakesh Kumar Singh, examined the evidence placed on record.
It ruled that the accident happened due to the rashness and negligence of the car driver.
The tribunal noted that the driver did not appear in court to explain how the accident occurred.
Because of this, the court drew an adverse inference against the driver.
The tribunal also observed that the insurance company failed to disprove the injured man’s testimony.
Insurance Company Failed to Counter Evidence
The tribunal said the insurance firm could not bring any evidence to challenge the victim’s version of events.
The cross-examination of Pradeep Mehra did not raise any doubt about the accident or the involvement of the vehicle.
The court clearly stated that there was no reason to question Mehra’s account of rash driving.
60 Percent Functional Disability Assessed
Medical records showed that Mehra suffered 60 percent functional disability in his upper and lower limbs.
The tribunal said he would face severe difficulties in daily life.
These include problems in walking, climbing stairs, lifting objects and performing routine activities.
The court acknowledged that such disability would affect his quality of life permanently.
Loss of Future Income Considered
At the time of the accident, Mehra was working as a cargo assistant.
He was only 34 years old when the incident occurred.
Considering his age, job profile and disability, the tribunal calculated a major loss of future income.
Out of the total compensation, ₹51.40 lakh was awarded towards loss of future earning capacity.
Insurance Company Directed to Pay Amount
The tribunal noted that the offending vehicle was insured at the time of the accident.
It directed Liberty General Insurance Ltd to deposit the compensation amount.
The insurer has been given 30 days to pay the awarded sum.
The judgment reinforces the importance of road safety and accountability in motor accident cases.
